User Responsibilities

When You Upload Content to ZipLove

You represent and warrant that:

  • You     own the copyright to the content OR have permission to use it
  • Your     content doesn't infringe anyone else's intellectual property rights
  • You     have the right to upload and share the content
  • You     have necessary releases from people pictured in photos

Content You Can Upload

Allowed:

  • Photos     you took yourself
  • Photos     where you have written permission from the photographer
  • Images     you created
  • Licensed     stock photos (with proper license)
  • Content     in the public domain
  • Content     where you own the copyright

Content You Cannot Upload

Not Allowed:

  • Professional     photos without photographer's permission
  • Photos     you found on Google Images or other websites
  • Celebrity     or influencer photos
  • Copyrighted     artwork or graphics without permission
  • Screenshots     from movies, TV shows, or other copyrighted works
  • Other     people's photos from social media without permission
  • AI-generated     images of real people without consent

Violation of these rules may result in:

  • Content     removal
  • Account     warning or suspension
  • Permanent     ban for repeat violations
  • Legal     liability for copyright infringement

How ZipLove Uses Your Content

When you upload content to ZipLove, you grant us a licenseto:

  • Display     your content in the app
  • Store     your content on our servers
  • Show     your content to other users
  • Use     your content for promotional purposes (with notice)

However:

  • You     retain ownership of your copyright
  • We     won't sell your content to third parties
  • You     can delete your content anytime

Filing a DMCA Copyright Infringement Notice

If You Believe Your Copyright Has Been Infringed

If you're a copyright owner (or authorized agent) andbelieve content on ZipLove infringes your copyright, you can file a DMCAtakedown notice.

What You Need to Include

Your DMCA notice must contain:

How to Submit Your DMCA Notice

Important:

  • Include     "DMCA Takedown Notice" in subject line
  • Attach     any supporting evidence (screenshots, links to your original work, etc.)
  • False     DMCA claims may result in legal consequences

What Happens After You File

Within 24-48 hours:

  • We'll     review your notice
  • If     valid, we'll remove or disable access to the allegedly infringing content
  • We'll     notify the user who uploaded the content
  • Content     stays down pending resolution

Invalid Notice:

  • We'll     notify you if the notice doesn't meet DMCA requirements
  • You     can refile with correct information

If your content was removed due to a DMCA notice and youbelieve the removal was a mistake or misidentification:

What to Include

Your counter-notification must contain:

    • "I      swear, under penalty of perjury, that I have a good faith belief that the      material was removed or disabled as a result of mistake or      misidentification of the material to be removed or disabled."

  7. Consent     to Jurisdiction:
       
    • "I      consent to the jurisdiction of the Federal District Court for the      judicial district in which my address is located (or the [relevant      district] if my address is outside the United States), and I will accept      service of process from the person who provided the original DMCA      notification or an agent of such person."

How to Submit Counter-Notification

What Happens After Counter-Notification

Within 10-14 business days:

  • We     forward your counter-notification to the original complainant
  • If     they don't file a lawsuit within 10-14 days, we may restore your content
  • If     they file suit, the matter is between you and them

Warning: Filing a false counter-notification mayresult in legal liability.

Repeat Infringer Policy

ZipLove has a policy of terminating accounts of repeatcopyright infringers.

What Happens:

  • First     Violation: Warning + content removal
  • Second     Violation: Temporary suspension (30 days) + content removal
  • Third     Violation: Permanent account termination

Serious Violations:

  • Egregious     or willful infringement may result in immediate permanent ban
  • We     may report severe cases to law enforcement

Counter-Notifications:

  • Successful     counter-notifications don't count as strikes
  • We     remove strikes if content is restored

Trademark Policy

This policy also applies to trademark infringement.

Trademarks on ZipLove

You Cannot:

  • Use     another company's logo as your profile picture
  • Impersonate     brands or businesses
  • Use     trademarked names to mislead others
  • Sell     counterfeit goods using our platform

Fair Use

What is Fair Use?

Fair use allows limited use of copyrighted material withoutpermission for purposes like:

  • Commentary     or criticism
  • News     reporting
  • Teaching     or research
  • Parody

However:

  • Fair     use is determined case-by-case
  • It's     a legal defense, not a right
  • Courts     consider: purpose, nature of use, amount used, market effect

On ZipLove:

  • Personal     dating/friendship profiles are generally not fair use
  • Using     professional photos without permission is typically not fair use
  • "I     found it on Google" is not fair use

If Unsure:

  • Get     permission
  • Use     your own photos
  • Use     licensed stock photos

Other Intellectual Property

Publicity Rights

Using someone's name, image, or likeness for commercialpurposes without permission may violate their right of publicity, even ifthere's no copyright infringement.

On ZipLove:

  • Don't     use celebrity photos in your profile
  • Don't     impersonate public figures
  • Don't     use photos of other people without their consent

Patents

  • ZipLove     respects patent rights
  • If     you believe our app infringes your patent, contact: legal@ziplove.org

ZipLove's Copyright

Our Intellectual Property

ZipLove owns or licenses:

  • The     ZipLove name and logo
  • App     design and user interface
  • Website     design and content
  • Marketing     materials
  • Software     and code

You May Not:

  • Copy     or reproduce the ZipLove app
  • Use     our logo without permission
  • Scrape     or collect data from our platform
  • Reverse     engineer our software

Limited Use Permission:

  • You     may screenshot the app for reviews or support requests
  • You     may link to ziplove.org
  • Media     may use our logo for news coverage (contact: press@ziplove.org)

Safe Harbor Provisions

ZipLove qualifies for DMCA safe harbor protections as aservice provider under 17 U.S.C. § 512(c) because:

  1. We     don't have actual knowledge of infringement
  2. We     don't receive financial benefit directly from infringing activity
  3. We     act expeditiously to remove infringing content when notified
  4. We     have a designated DMCA agent
  5. We     have a repeat infringer policy

This means we're not liable for user-uploaded content if wefollow proper DMCA procedures.

International Copyright

For International Users:

  • Copyright     laws vary by country
  • We     comply with DMCA (U.S. law)
  • We     also respect international copyright laws where applicable
  • EU     users: We comply with EU Copyright Directive
